These Terms of Service (“Terms”) govern your use of the Vinum Italia website and your purchase of alcoholic beverages from us. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our site or place an order.
1. Eligibility
You must be at least 21 years of age and legally permitted to purchase and consume alcohol in California to use our website or place an order. You represent and warrant that:
- You are 21 years of age or older.
- You are purchasing alcohol for personal use or lawful gifting, not for resale in violation of state or federal law.
- All information you provide is accurate and truthful.
2. Scope of Service
Our website is intended for customers located within California only. We currently do not ship alcoholic beverages outside of California. Orders with non‑California shipping addresses will be cancelled or held until corrected to a valid California address.
3. Product Orders and Availability
- Prices, product descriptions, and availability are subject to change without notice.
- We reserve the right to limit quantities, refuse orders, or cancel orders for any reason, including failure to complete age verification or address validation.
4. Shipping and Delivery
- All alcoholic beverages are shipped within California via UPS, using Adult Signature Required service. A person aged 21 or older must be present at the delivery address to present a government‑issued photo ID and sign for the package.
- If no valid adult is present or the recipient refuses delivery, the shipment may be returned or redelivered at your expense, and we may cancel the order or charge restocking/delivery fees.
- We are not responsible for delays caused by UPS, weather, or other factors beyond our control.
5. Returns, Refunds, and Liability
- Due to California alcohol regulations, we generally do not accept returns on opened or delivered alcohol. Refunds or exchanges are offered only in limited circumstances and at our sole discretion.
- We are not liable for any misuse of alcohol, including but not limited to drunk driving, health issues, or accidents related to alcohol consumption.
- If we send you the wrong wine, or your wine arrives damaged, please email us directly at including a picture of all of the damaged bottles and we will either replace your item (no charge to you), or refund your purchase (in the case of damaged goods). Please allow 30 days for processing of returns. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
6. Prohibited Use
You agree not to use our website or products to:
- Sell, distribute, or resell alcohol in violation of state or federal law.
- Ship alcohol to minors or to anyone under 21 years of age.
- Provide false or misleading information during checkout or age verification.
7. Limitation of Liability
To the fullest extent permitted by law, Vinum Italia and its affiliates disclaim all liability for indirect, incidental, or consequential damages arising from your use of our website or products. Our liability in any case is limited to the amount you paid for the specific product in question.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict‑of‑laws principles. Any disputes arising from or relating to these Terms or your use of our website shall be resolved in the state or federal courts located in California.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of our website after changes constitutes your acceptance of the updated Terms.
